Report Content and Copyright Infringement
Contents
Bookfairy is a service of Orbita Media GmbH, Ericusspitze 4, 20457 Hamburg, Germany. If you believe that content stored with Bookfairy is illegal, for example a manuscript, cover or book that infringes your copyright, tell us. We review every notice and tell you what we decided.
Report illegal content (Art. 16 DSA)
Use the reporting function in the application or send an email to kontakt@orbita-media.de with the subject "DSA notice", in German, English or Italian. Please include:
- Why you believe the content is illegal, explained as precisely as you can.
- Where it is: the exact link, or the book, project or code concerned.
- Your name and email address (not required if the notice concerns offences against children).
- A statement that you believe in good faith that the information in your notice is accurate and complete.
We confirm receipt, review the notice carefully and objectively, and tell you our decision and the ways to challenge it. If we block content, we inform the customer who uploaded it and give the reasons.
Report copyright infringement (DMCA)
If you own the copyright in a work, or act for the owner, and the work is stored or published through Bookfairy without permission, send a notice under the US Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)) to our designated agent. A notice with these details also counts as a notice under Art. 16 DSA, so you do not need to send both.
Designated agent: Copyright Agent, Orbita Media GmbH, Ericusspitze 4, 20457 Hamburg, Germany. Phone: +49 156 79036138. Email: dmca@orbita-media.de
Your notice must contain:
- Your physical or electronic signature (a typed full name is enough).
- The copyrighted work, or a list of the works if the notice covers several.
- The material you want removed and where it is: the exact link, or the book or project concerned.
- Your address, phone number and email address.
- A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner.
Anyone who knowingly claims that material is infringing when it is not may be liable for damages, including costs and attorneys' fees (17 U.S.C. § 512(f)).
Counter notification
If we removed or disabled your material and you believe this was a mistake or a misidentification, send a counter notification to the same agent. It must contain:
- Your physical or electronic signature.
- The material that was removed and where it appeared before it was removed.
- A statement under penalty of perjury that you believe in good faith that the material was removed because of a mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the US Federal District Court for your address or, if your address is outside the United States, for any judicial district in which Orbita Media GmbH may be found, and that you will accept service of process from the person who sent the notice or their agent.
We send a copy to the person who filed the notice and tell them that we will restore the material in 10 business days. We restore it 10 to 14 business days after we receive the counter notification, unless that person first tells our agent that they have filed a court action to stop the infringement.
Repeat infringers
We close the accounts of users who repeatedly infringe copyright, where appropriate. We record every valid notice against the account it concerns. As a rule, an account is closed after the third valid notice within twelve months that was not answered by a successful counter notification; in clear cases sooner. The Terms and Conditions allow termination for repeated infringement of third-party rights (§ 16(7)).
Contact point
Single point of contact under Articles 11 and 12 DSA: kontakt@orbita-media.de, languages German, English and Italian. Further details are in the Legal notice.
