Right of Withdrawal
Contents
This policy applies to consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession (Section 13 of the German Civil Code, BGB). Businesses have no right of withdrawal. This policy corresponds to the annex to our Terms and Conditions (§ 13). This English text is a translation; the German version is authoritative.
Withdrawal policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us, Orbita Media GmbH, Ericusspitze 4, 20457 Hamburg, Germany, phone: +49 156 79036138, email: kontakt@orbita-media.de, of your decision to withdraw from this contract by an unequivocal statement, for example a letter sent by post or an email. You may use the attached model withdrawal form, but it is not obligatory.
You can also exercise your right of withdrawal online using the "Withdraw from contract" link that you will find in your account under "Orders and invoices", or directly at getbookfairy.com/account/withdraw (no login needed). If you use this online function, we will send you an acknowledgement of receipt on a durable medium (for example by email) without undue delay, stating the content of your withdrawal and the date and time it was received.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Special note on digital content and digital services
In the case of a contract for the supply of digital content that is not supplied on a tangible medium, your right of withdrawal expires prematurely if we have begun performing the contract after you have expressly consented to our beginning performance of the contract before the end of the withdrawal period, you have acknowledged that by giving your consent you lose your right of withdrawal once performance of the contract begins, and we have provided you with a confirmation in accordance with Section 312f BGB.
In the case of a contract for the provision of a digital service, your right of withdrawal expires if we have fully performed the service and only began performance after you gave your express consent and at the same time acknowledged that you lose your right of withdrawal once we have fully performed the contract.
If you requested that the service should begin during the withdrawal period, you shall pay us a reasonable amount which is in proportion to the services already provided up to the time you inform us of the exercise of the right of withdrawal with regard to this contract, in comparison with the full scope of the services provided for in the contract.
What this means at Bookfairy
The following explanations are not part of the statutory withdrawal policy. They show how the rules apply to our tools.
Starting right away only with your consent. Many tools deliver their result within minutes, for example a cover, a book blurb, a keyword list or an EPUB. So that we may start immediately after your purchase, we ask you for two declarations in the ordering process, directly above the order button:
- that you expressly consent to our beginning performance of the contract before the end of the withdrawal period, and
- that you are aware that you thereby lose your right of withdrawal once performance begins (for digital content) or once the service has been fully performed (for digital services).
You then receive a confirmation of the contract by email that records your consent and your acknowledgement (Section 312f BGB). Without these declarations, we only start after the withdrawal period has ended.
If we have not started yet, for example because you bought a tool but have not run it, your right of withdrawal remains in full and you get the full amount back.
Free previews (for example watermarked cover drafts, the sample chapter of a book or the first 3,000 edited words) cost you nothing; no withdrawal is needed for them.
After a withdrawal you may no longer use the digital content provided or make it available to third parties. Your own content, such as the manuscript you uploaded, remains available to you on request (§ 13(7) of the Terms and Conditions, Section 327p BGB).
